Welcome to GolfHer! These Terms of Service ("Terms") govern your use of the GolfHer mobile application and website (the "Service"), operated by Technolica, Inc. ("we," "our," or "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years of age to use GolfHer. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate and complete information when creating your account and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use GolfHer respectfully and in accordance with our Community Guidelines. You will not:

• Harass, threaten, intimidate, or bully other users
• Post content that is offensive, discriminatory, sexually explicit, or illegal
• Impersonate another person or misrepresent your identity
• Use the Service for commercial solicitation or spam
• Attempt to access other users' accounts or our systems without authorization
• Use bots, scrapers, or automated tools to access the Service
• Engage in any activity that disrupts or interferes with the Service

4. User Content

You retain ownership of content you post on GolfHer (photos, reviews, messages, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service. You represent that you have the right to post such content and that it does not violate any third-party rights.

We may remove content that violates these Terms or our Community Guidelines at our discretion.

5. AI Caddie & Recommendations

The AI Caddie provides club recommendations based on algorithms, weather data, and user inputs. These recommendations are for informational and entertainment purposes only. We make no guarantees about the accuracy or suitability of AI recommendations. You are solely responsible for your club selection and play decisions on the course.

6. Subscriptions & Payments

GolfHer offers free and premium subscription plans (GolfHer+ and GolfHer Pro). Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your device's app store settings.

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

7. Course Reviews

Course reviews and amenity reports are user-generated and may not be accurate. GolfHer does not verify user-submitted course information including restroom locations, food availability, walkability ratings, or other amenity details. Use this information as a general guide only.

8. Safety & Meetups

GolfHer facilitates connections between golfers but is not responsible for in-person interactions. When meeting other users:

• Meet in public places (golf courses are great for this!)
• Let someone know where you're going
• Trust your instincts — if something feels wrong, leave
• Report any concerning behavior through the app

We are not liable for any damages, injuries, or disputes arising from in-person meetups arranged through the Service.

9. Intellectual Property

The GolfHer name, logo, design, and all associated intellectual property are owned by Technolica, Inc. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission.

10. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you consent to our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNOLICA, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Technolica, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
